Hindu Marriage Act Registration — Overview
Under Section 8 of the Hindu Marriage Act, 1955, State Governments may make rules for compulsory registration of Hindu marriages. Puducherry (like most states) requires registration of Hindu marriages. This means that even if you have already performed the religious ceremony (saptapadi, kanyadaan, etc.), you must get the marriage registered with the Sub-Registrar to obtain a legal marriage certificate.
The Hindu Marriage Act applies to Hindus, Buddhists, Sikhs and Jains. Both parties must be Hindu at the time of marriage.
Eligibility Conditions (Section 5 HMA)
- Neither party has a living spouse (i.e., either unmarried, or previous marriage dissolved/spouse deceased)
- Neither party is of unsound mind or incapable of giving valid consent
- Groom must be at least 21 years old; Bride must be at least 18 years old
- Parties are not within the degrees of prohibited relationship (unless custom or usage permits)
- Parties are not sapindas of each other (unless custom or usage permits)
Documents Required
- Marriage Registration Application (Form)
- Aadhaar card of bride and groom
- Age proof: Birth certificate or 10th class marksheet (both parties)
- Address proof (Aadhaar / EB bill / Voter ID) of both parties in Pondicherry
- Marriage photograph (joint photograph at wedding ceremony)
- Wedding invitation card (if available)
- Priest's certificate / Pandit certificate on temple letterhead confirming marriage solemnisation
- 2 witnesses with Aadhaar cards and passport photos
- Court fee stamp (as required by the Registrar)
Process in Pondicherry
