What Is Court Marriage?
A "court marriage" refers to a civil marriage solemnised by the Marriage Officer (typically the Sub-Divisional Magistrate or Collector-designated officer) under the Special Marriage Act, 1954. It is a secular marriage — no religious ceremony is required. The marriage is performed in front of three witnesses and the Marriage Officer, who signs the Marriage Certificate.
Court marriage is available to all citizens of India regardless of religion. It is the preferred choice for inter-religion and inter-caste couples, as well as for those who want a legally recognised marriage without elaborate religious rituals.
Eligibility for Court Marriage
- Age: Groom must be at least 21 years old; Bride must be at least 18 years old.
- Marital Status: Neither party must have a living spouse (i.e., no existing undissolved marriage).
- Prohibited Degrees: The parties must not be within the degrees of prohibited relationship (unless their personal law or custom permits it — Section 4 SMA).
- Sound Mind: Both parties must be capable of giving valid consent — not of unsound mind, not suffering from mental disorder, not a recurrent lunatic.
- Residence: At least one party must have lived in the district for at least 30 days before giving notice.
Court Marriage Process — Step by Step
Both parties file a Notice of Intended Marriage with the Marriage Officer of the district where at least one party has resided for 30 days. The notice is entered in the Marriage Notice Book (which is open for public inspection).
The notice is published publicly. Any person may object to the marriage within 30 days on the grounds stated in Section 7 (e.g., the parties are within prohibited degrees, or one of them has a living spouse). If no valid objection is received, the marriage can proceed.
Both parties and three witnesses appear before the Marriage Officer. The parties declare that they take each other as husband/wife. The Marriage Officer, parties and witnesses sign the Marriage Certificate Book.
A certified extract of the Marriage Certificate is issued (Section 13). This is the official government marriage certificate — recognised by courts, banks, embassies and all government offices.

- Aadhaar card of both parties
- Age proof (birth certificate, 10th marksheet or school leaving certificate)
- Address proof showing 30-day residence in Pondicherry (Aadhaar / EB bill / bank statement)

- Affidavit of marital status (that neither party has a living spouse)
- Identity proof of 3 witnesses + their Aadhaar cards
- If previously married: Divorce decree or death certificate of previous spouse
