What Is a Succession Certificate?
A Succession Certificate is a document issued by a District Court under Section 372 of the Indian Succession Act, 1925. It authorises the holder — a legal heir of a person who died without a will (intestate) — to collect debts, securities and other movable financial assets belonging to the deceased: bank account balances, fixed deposits, shares and mutual funds, insurance policy proceeds, and provident fund dues. Without it, banks and financial institutions in Pondicherry will not release the deceased's funds to the family, even where the heirs are not in dispute.
The certificate is obtained by filing a petition — commonly referred to by its case type, Succession OP (Original Petition) — before the District Court within whose jurisdiction the deceased ordinarily resided at the time of death, or where any of the deceased's property is situated if there was no fixed place of residence.
