Before filing, conduct a thorough trademark search on the IP India Trademark Search portal (ipindiaonline.gov.in) to check if an identical or similar mark already exists in your class. A conflict with an existing mark will likely result in refusal or opposition. This step saves significant time and money.

File TM-A Application Online

File Form TM-A on the IP India portal. Government filing fee: Rs.4,500 per class for individuals, startups and small enterprises; Rs.9,000 per class for large entities. After payment, you immediately receive the application number and can use the TM (Trade Mark) symbol while the application is pending.

Examination and Objections

The Trade Marks Registry (Chennai office has jurisdiction for South India including Pondicherry) examines the application within 30 working days under the revised rules. If there are objections (absolute or relative grounds), the examiner issues an examination report. You must file a response within 30 days. If your response is not accepted, you can request a hearing.

Publication in Trademark Journal

If the application passes examination, it is published in the Trade Marks Journal (published online weekly). Any third party has 4 months from the date of publication to file an opposition (TM-O form) if they believe the mark conflicts with their existing rights.

Registration and Certificate

If no opposition is filed within 4 months, or if opposition proceedings are decided in your favour, the trademark is registered. The Certificate of Registration is issued and the mark is valid for 10 years from the application date, renewable in perpetuity.

No. The ® symbol can only be used after the trademark is officially registered and the certificate is received. However, you can use the ™ (TM) symbol immediately after filing the application, while it is pending registration. Using ® before registration is a legal misrepresentation under the Trade Marks Act.

With the current processing times at the Trade Marks Registry, the complete process from filing to registration (assuming no opposition and no major objections) typically takes 18-24 months. If there is an objection that requires a hearing, add 6-12 months. If someone opposes the trademark, resolution can take 3-5 years in contested cases.

If someone uses your registered trademark without permission (infringement), you can (1) send them a legal cease and desist notice, (2) file a civil suit for trademark infringement and passing off before the District Court in Pondicherry or the Madras High Court, and (3) file a criminal complaint under Section 103 of the Trade Marks Act (which provides for imprisonment up to 3 years).
