Why NRIs Need Power of Attorney for Pondicherry Property
Non-Resident Indians (NRIs) and Persons of Indian Origin (PIOs) who own property in Pondicherry face a practical challenge: they cannot be physically present in India for every transaction, legal proceeding, or administrative matter related to their property. A Power of Attorney (PoA) authorises a trusted person in Pondicherry (a family member, friend or professional) to act on the NRI's behalf.
A PoA is required for: selling or purchasing property, appearing before the Sub-Registrar during registration, executing lease agreements, paying property tax, dealing with revenue authorities (patta, chitta, adangal), representing the NRI in court proceedings, managing bank accounts and loan matters, and paying utility bills or maintenance charges.
General PoA vs Specific PoA - Which Should an NRI Choose?
- General Power of Attorney (GPA): Authorises the holder to perform virtually any legal act on behalf of the NRI - sell property, sign documents, appear in courts, manage bank accounts, etc. GPAs are broad and powerful but carry risk of misuse if given to an untrustworthy person.
- Specific / Special Power of Attorney (SPA): Limited to specific acts - for example, "to sell the property at No.X, Survey No.Y, Pondicherry" or "to appear before the Sub-Registrar for the registration of the sale deed." SPAs are safer and are preferred for single transactions.
Legal recommendation: For property sale or purchase transactions in Pondicherry, always use a Specific PoA clearly stating the exact property, the specific act authorised (e.g., "to execute the sale deed and register the same at the Sub-Registrar Office, Nellithope, Pondicherry") and an expiry date (e.g., valid for 12 months).
How NRIs Can Execute a PoA from Abroad
Draft the PoA (Get it Drafted in India)
Have the PoA drafted by an advocate in Pondicherry who knows the specific property details, the intended transaction and the legal requirements. The draft is sent to the NRI abroad via email. Review it carefully before signing. The PoA should be on stamp paper of appropriate value if executed in India, but when executed abroad, it is typically on plain paper.
Notarise the PoA Abroad
The NRI signs the PoA before a Notary Public in the country they reside in. The Notary certifies the NRI's signature and identity. This step is mandatory in all cases.
Apostille (Hague Convention Countries) OR Indian Embassy/Consulate Attestation
For countries that are members of the Hague Apostille Convention (USA, UK, Australia, Canada, Germany, UAE - now part of the convention since 2024, Singapore, etc.), the notarised PoA must be apostilled by the competent authority in that country (Secretary of State in USA, FCO in UK, etc.). An apostille is a standardised international certification.
For countries NOT in the Apostille Convention (previously Gulf countries, now largely covered), the PoA must be attested by the Indian Embassy or Consulate in that country.
Register the PoA at Pondicherry Sub-Registrar Office
Once the apostilled/attested PoA arrives in India, it must be adjudicated and registered at the Sub-Registrar Office, Nellithope, Pondicherry within 3 months of its execution date. The holder (attorney) takes the PoA to the SRO along with the NRI's identity proof, the original PoA and stamp duty (typically Rs.100 to Rs.500 depending on scope). Once registered, the PoA is a valid and enforceable document in Pondicherry.
Common NRI Property Issues in Pondicherry and How PoA Helps
- Encroachment: Local parties illegally occupying NRI land in Pondicherry. The PoA holder can file police complaints, approach revenue authorities for mutation correction and file civil suits for recovery of possession.
- Illegal Occupation by Relatives: Family members not vacating property. The PoA holder can send legal notices and file eviction suits on the NRI's behalf.
- Property Tax and Revenue Records: The PoA holder can update patta in the NRI's name, pay property tax and obtain EC, patta copies from revenue offices.
- Sale of Inherited Property: When an NRI inherits property in Pondicherry through succession, they need to first obtain a succession certificate or legal heir certificate, and then use a PoA to execute the sale.

Frequently Asked Questions
For PoAs authorising the sale of immovable property, registration is mandatory under Section 17 of the Registration Act, 1908. An unregistered PoA for property sale is not valid. For other general acts (like appearing in court, paying bills), registration is advisable but not always mandatory. Always register the PoA to avoid complications.
Apostille is a simplified certification accepted in all 118 member countries of the Hague Apostille Convention. It is done by a designated authority in the issuing country (like Secretary of State in USA). Consulate/Embassy attestation is required for countries not in the Apostille Convention - the Indian Embassy physically stamps and certifies the document. Since UAE joined the Apostille Convention in 2024, apostille now covers most major countries where NRIs reside.
An attorney (PoA holder) generally cannot sell the principal's property to themselves, as this creates a conflict of interest. Courts have struck down such self-dealing transactions. The PoA should explicitly state that the attorney cannot transfer the property to themselves, their family or associated entities. Always have an advocate review the PoA before granting it.
Revocation must be done by executing a Revocation Deed, getting it notarised/apostilled abroad (if you are outside India), and then registering it at the same Sub-Registrar Office where the original PoA was registered. The original PoA holder must also be formally notified in writing. An unregistered revocation is not effective against third parties who act in good faith relying on the original PoA.
