Filing a Civil Suit in Pondicherry District Court: Procedure, Court Fees and What to Expect

Civil Court Hierarchy in Pondicherry

Pondicherry has its own civil court hierarchy as a Union Territory. Understanding which court has jurisdiction over your dispute is the first step:

  • Munsiff Court: Handles civil suits where the value of the suit (subject matter value) is below Rs.3 lakh.
  • Civil Judge (Junior Division) / Sub Judge Court: Handles suits valued between Rs.3 lakh and Rs.25 lakh.
  • Principal District Court, Puducherry: Handles suits valued above Rs.25 lakh and all suits requiring original jurisdiction of the District Court. Located at Kamaraj Salai, Pondicherry 605001.
  • Madras High Court: Appeals from the District Court; also has original civil jurisdiction for suits above Rs.1 crore (original side).

Territorial jurisdiction: The suit must be filed in the court within whose jurisdiction the defendant resides, carries on business, or the cause of action (the event giving rise to the dispute) arose.

Step-by-Step Process to File a Civil Suit in Pondicherry

Send a Legal Notice First

Before filing a suit, it is common practice (and sometimes legally required) to send a legal notice to the opponent giving them an opportunity to settle. In money recovery suits, this also helps establish the legal demand clearly. If the opponent ignores the notice, you proceed to court.

Drafting the Plaint

The plaint is the written complaint filed before the court. It must contain the names and addresses of plaintiff and defendant, facts of the case in chronological order, the legal cause of action, the relief claimed (money, injunction, declaration, specific performance) and the value of the suit for court fee purposes. The plaint must be drafted carefully - defects at this stage can delay the case significantly.

Pay Court Fee

Court fee in Pondicherry is paid by affixing court fee stamps to the plaint. The fee is calculated on the value of the suit on an ad valorem basis - typically 1% to 7.5% depending on the type of relief claimed. For a money suit of Rs.1 lakh, the court fee is approximately Rs.1,000 to Rs.7,500. The Pondicherry Court Fees Act applies.

Temporary Injunction - Getting Urgent Relief in Pondicherry
